Ubytovanie u Maťka a Kubka · working draft, version 1.0 · updated 10 October 2026 · effective from: [EFFECTIVE DATE FOLLOWING APPROVAL]
1. Your accommodation provider
1.1 Accommodation is provided by Mgr. Vladimír Mačák, place of business: Ždiar 281, 059 55 Ždiar, business registration number (IČO) 46 505 164, tax identification number (DIČ) 1040139122, registered in the Trade Register of the Poprad District Office under No. 740-27446 (the “accommodation provider”, “we” or “us”).
1.2 Property: Ubytovanie u Maťka a Kubka, Ždiar 281, 059 55 Ždiar. Contact: umatkakubka@gmail.com, +421 904 380 473, www.umatkakubka.sk. Complaints and other correspondence may also be sent by post to Ždiar 281, 059 55 Ždiar.
1.3 Supervisory authority: Slovak Trade Inspection, Inspectorate for the Prešov Region, Obrancov mieru 6, 080 01 Prešov 1.
1.4 Andrej Petrulák – TatraByte, business registration number (IČO) 57647194, operates the Rezerva booking system for us. TatraByte is not a party to the contract; the accommodation contract is concluded solely between you and us.
1.5 These terms apply to bookings made through the booking form on our website and to bookings made by telephone, email or in person if we refer to them in the confirmation. We provide accommodation under an accommodation contract pursuant to §§ 754–759 of the Slovak Civil Code; the house rules are set out in Article 8.
1.7 If you are a consumer, you retain all rights under Slovak Act No. 108/2024 Coll. on consumer protection and the Civil Code; any provision of these terms that would restrict those rights does not apply. If you book in the course of your business, consumer provisions do not apply and the relationship is governed by the Slovak Commercial Code.
2. What we offer
2.1 The house has two guest rooms and two apartments. You may book individual rooms and apartments or the entire guest accommodation for up to 16 people. The owners live in a separate part of the house. Descriptions, facilities and capacities are given on the website and in the booking form.
2.2 A sauna, outdoor hot tub and extra sleeping space on a chair bed or sofa bed are available at an additional charge shown in the price list. You select these in the form or arrange them on site; the form must never preselect them.
2.3 Bookings for the entire guest accommodation and groups: [TO BE COMPLETED BY THE OWNER — for example, by request only under Article 3.3, a different deposit or different cancellation terms; this must match the settings in Rezerva].
3. How the contract is concluded
3.1 On the booking page, choose your dates, a room, apartment or the entire guest accommodation, and any additional services. Before submitting, you will see a summary showing what you are booking, the dates and number of nights, the number of guests, the total price including accommodation tax, the deposit amount and payment deadline, cancellation terms expressed in euros, notice that you have no right of withdrawal under § 19(1)(l) of Slovak Act No. 108/2024 Coll., and the complaints procedure. You can check and correct all details in the form or by returning to the previous step before submitting.
3.2 Instant booking. Submit using the “Book with an obligation to pay” button. The contract is concluded when the system confirms your booking.
3.3 Booking request. If the form states that you are submitting a request, particularly for the entire guest accommodation or a group, use the “Send request with an obligation to pay” button. The contract is concluded only when we confirm the request by email. We will reply within 24 hours; if we do not, the request lapses. You may cancel your request free of charge until we confirm it.
3.4 Immediately after submission, we will email you to acknowledge receipt of your booking or request. Confirmation of the contract will also be sent by email, including your stay details, an itemised total price, the deposit and payment details, cancellation terms expressed in euros, and a link to the version of these terms you accepted.
3.5 For bookings made by telephone, email or in person, the contract is concluded when we confirm the booking. We will send the confirmation and these terms by email.
3.6 The contract is concluded in Slovak. If you choose another website language, information will be provided in that language; in the event of a discrepancy between language versions, the Slovak version prevails. We retain the contract confirmation and the accepted version of these terms and will send them to you on request.
3.7 The person making the booking must be over 18. That person is responsible for paying for all guests included in the booking and for informing them of these terms.
4. Prices and payments
4.1 Prices are in euros and are final. [We are not registered for VAT. / Prices include VAT.] Accommodation is charged per night and per [room / apartment / entire guest accommodation / person] according to the price list in force when you book.
4.2 Accommodation tax is €2 per person per night under Ždiar municipal regulation No. 1/2026; guests under 15 are exempt. The tax is paid by the guest; we collect it and pay it to the municipality. It is shown separately within the total amount in the summary before submission and in the confirmation, and you will receive proof of payment. If the municipality changes the rate after your booking, the rate applicable during your stay will apply; we will inform you of the change in advance.
4.3 You pay for additional services, such as the sauna and hot tub, only if you expressly order them.
4.4 Deposit. A deposit of 30% of the accommodation price is payable when booking. For bank transfers, it is due within [NUMBER OF DAYS — TO BE COMPLETED BY THE OWNER] days of booking confirmation. If it is not paid on time, the booking lapses; we will notify you by email and no payment is due. The deposit is deducted from the price of your stay. [IF CARD PAYMENTS ARE USED, ADD HOW AND WHEN THE DEPOSIT IS PAID.]
4.5 The remaining balance is payable no later than departure, in cash or by bank transfer as agreed. For payments made on site, you will receive a receipt from the eKasa cash register.
4.7 If you need a business invoice, provide your billing details when booking.
5. Statutory right of withdrawal
5.1 Accommodation is provided for specifically agreed dates. Under § 19(1)(l) of Slovak Act No. 108/2024 Coll., you therefore do not have the right to withdraw without giving a reason within 14 days that consumers otherwise have for distance contracts. The same applies to a sauna or hot tub session booked for a specific time.
5.2 You may cancel your booking at any time under Article 6. This does not affect your rights under the Civil Code, such as withdrawal if we materially breach the contract.
6. Cancellation by the guest and no-shows
6.1 You may cancel at any time using the link in your confirmation email, by emailing umatkakubka@gmail.com or by calling +421 904 380 473. The date we receive your cancellation is decisive. We will confirm the cancellation by email, including the date and time.
6.2 When you cancel, we may be unable to sell the dates held for you to another guest and may incur a loss. Under § 759(1) of the Slovak Civil Code, you compensate us only for a loss we could not have prevented. To make the amount clear in advance, we agree a fixed calculation based on how many days before arrival you cancel:
| When you cancel | Compensation as a share of the accommodation price for cancelled nights |
|---|---|
| more than 21 days before arrival | [5 %] |
| 21–14 days before arrival | [10 %] |
| 13–7 days before arrival | [25 %] |
| 6–2 days before arrival | [40 %] |
| 1 day before arrival | 50 % |
| on the day of arrival or if you do not arrive | [TO BE COMPLETED BY THE OWNER] |
The accommodation price means the price for the nights booked, excluding accommodation tax and additional services that were not provided. If you select an offer with different cancellation terms, such as a non-refundable rate, those terms apply; they will be shown in euros before submission and in the confirmation.
6.3 Compensation never exceeds the accommodation price for the cancelled nights. It is an agreed amount of loss, not a contractual penalty.
6.4 If we sell your cancelled dates to another guest, we reduce the compensation by the amount received and refund the difference. If you demonstrate that our actual loss was lower, you pay only that loss.
6.5 We offset compensation against your deposit. If the deposit is higher, we refund the difference within 14 days of cancellation using the same payment method.
6.6 No-show. If you do not arrive on your arrival date and have not cancelled, we hold your room or apartment until [12:00] the following day. After that, we may offer it to another guest and treat the booking as cancelled.
6.7 Late arrival and early departure. For nights you do not use because you arrive late or leave early, compensation is payable only for a loss we could not have prevented, up to the amount applicable to cancellation on the day of arrival.
6.8 Serious circumstances. If serious circumstances prevent your arrival, such as illness, injury, a death in the family, a natural disaster or a travel ban, and you provide evidence, [TO BE COMPLETED BY THE OWNER — for example, we will offer a free change of dates within [X] months].
6.9 Changes to your booking. Changes to dates or guest numbers are subject to availability. Shortening a stay after the free cancellation period is treated as cancellation of the affected nights.
7. Cancellation by the accommodation provider
7.1 If we cancel or cannot provide the accommodation as agreed, we will refund everything you have paid without undue delay, within 14 days at the latest, using the same payment method. We may offer alternative dates or comparable accommodation, but only with your consent. Your statutory right to compensation for damage is unaffected.
7.2 We may withdraw from the contract before the agreed end date if, despite a warning, a guest seriously breaches accepted standards of conduct, contractual obligations or the house rules (§ 759(2) of the Slovak Civil Code).
8. Arrival, stay and departure (house rules)
8.1 Arrival and departure. Check-in is from 14:00 to midnight on your arrival date; please let us know in advance if you will arrive later. Vacate your room or apartment by 10:00 on your departure date. Other times may be agreed.
8.2 Identity documents and registration. Each guest must show an identity document on arrival. We enter the details in the guest register (§ 24 of Slovak Act No. 253/1998 Coll.) and accommodation tax records (§ 41a of Act No. 582/2004 Coll.). Guests who are not Slovak citizens sign a completed residence reporting form, which we submit to the police within five days (§ 113 of Act No. 404/2011 Coll.). You may provide the details in advance through online check-in. We only inspect your identity document; we do not copy it.
8.3 Children. Guests under 15 may stay only with an accompanying adult. Guests aged 15–17 may stay unaccompanied only with written consent from their legal representative. Children under [13] must not be left without adult supervision in rooms, apartments or anywhere else in the house or grounds. The accompanying adult is responsible for children at the playground, in the sauna and by the hot tub.
8.4 Rules for the house and grounds.
- Quiet hours are from [22:00] to [7:00].
- Smoking and e-cigarettes are prohibited in all indoor areas and on balconies, in the sauna and at the playground. Smoking is permitted [outside the entrance and on the outdoor terrace].
- Visitors who are not staying at the property are welcome only by prior arrangement.
- Do not move furniture or make substantial changes to the premises (§ 757 of the Slovak Civil Code).
- Only everyday personal electrical appliances, such as chargers, hairdryers and shavers, may be used without prior agreement.
- Do not bring weapons or ammunition ready for immediate use, narcotics or psychotropic substances into the house.
- Use the barbecue and fire pit only in designated areas and follow our instructions.
- When leaving your room or apartment, close the windows and balcony doors, turn off taps, lights and appliances, and lock up.
- Guests’ pets: [TO BE COMPLETED BY THE OWNER — for example, not permitted / by arrangement at €X per night]. Our Samoyed dogs live on the property; please contact us before booking if you have an allergy.
- Parking: six spaces on the property beside the house, free of charge.
8.5 Sauna and hot tub. Book your session in advance or on site; prices are shown in the price list. Before your first use, we explain the rules and safety guidance; the operating rules displayed at the entrance also apply. Children may use these facilities only with an adult[, from age X]. Do not use the sauna or hot tub after drinking alcohol; if you have a medical condition, consult a doctor beforehand.
8.6 Lost property. We will contact you if you leave something behind. On request, we can post it to you at your expense; we keep it for [6 months].
9. Liability for damage
9.1 You are liable for the proven amount of damage you cause in the house or grounds under §§ 420 and 442 of the Slovak Civil Code. If the damage prevents us from letting a room or apartment, we may also claim proven lost income. We do not agree fixed penalties.
9.2 Liability for damage caused by a minor rests with the person responsible for supervising them, in accordance with § 422 of the Slovak Civil Code.
9.3 Please report any damage or fault as soon as you discover it.
9.4 We are liable for belongings brought into areas designated for accommodation or entrusted to us for safekeeping under §§ 433–436 of the Slovak Civil Code. Notify us of any loss or damage without undue delay; your right to compensation expires if you do not assert it by the fifteenth day after you became aware of it. We recommend entrusting money, jewellery and other valuables to us for safekeeping.
10. Reviews
10.1 Only a guest who receives a personal link after their stay can write a review on our website. Every review submitted through our website and displayed here therefore comes from someone who has actually stayed with us.
10.2 We do not edit reviews. We hide only reviews that contain offensive language, information about other people or content unrelated to the stay.
10.3 When we display reviews from other platforms, such as Booking.com or Google, we always give the source and date. We do not verify these reviews ourselves; Booking.com states that only guests who booked through its platform can leave a review there.
11. Complaints
11.1 We are responsible for ensuring that the accommodation and ordered services meet our agreement throughout your stay. If something does not, tell us as soon as possible, ideally during your stay, in person, by telephone or by email, so that we can put it right promptly. Your statutory rights are unaffected.
11.2 You may make a complaint in person, by email to umatkakubka@gmail.com or in writing to the address in Article 1.2. State what happened, when, and the remedy you propose.
11.3 Without undue delay after you make a complaint, we will provide written acknowledgement, including by email, stating the deadline for remedying the problem. This will not exceed 30 days from the date it was reported (§ 4(1)(j) of Slovak Act No. 108/2024 Coll.).
11.4 If the problem cannot be remedied, we will agree an appropriate solution, such as alternative accommodation, a price reduction or a refund for the affected part of your stay.
11.5 If we reject your complaint, we will give our reasons in writing (§ 4(1)(k) of Slovak Act No. 108/2024 Coll.).
12. Requests for redress and alternative dispute resolution
12.1 If you are dissatisfied with how your complaint was handled or believe we have infringed your rights, you may request redress by emailing umatkakubka@gmail.com or by post.
12.2 If we reject your request or do not reply within 30 days of it being sent, you may apply for alternative dispute resolution under Slovak Act No. 391/2015 Coll. The competent body is the Slovak Trade Inspection, Department for International Relations and Alternative Resolution of Consumer Disputes, Bajkalská 21/A, P. O. BOX 29, 827 99 Bratislava 27, ars@soi.sk, www.soi.sk/alternativne-riesenie-spotrebitelskych-sporov. Proceedings before the Slovak Trade Inspection are free. You may also contact another authorised legal entity on the Slovak Ministry of Economy’s list; it may charge up to €5 including VAT to initiate proceedings.
12.3 Apply within one year of the rejection of your request or the expiry of the 30-day response period. The alternative dispute resolution body may reject an application in the cases set out in § 13 of Slovak Act No. 391/2015 Coll., for example if the dispute is worth no more than €20. You may always take the matter to court.
13. Personal data protection
Our Privacy policy, also linked in the booking form, explains how we process your personal data.
14. Gift vouchers
14.1 You may order a gift voucher [by email / by telephone / in person]. It is valid for [12 months] from issue, is transferable, and can be redeemed when booking, subject to availability. If the stay costs more, you pay the difference.
14.2 If you bought the voucher at a distance, by email or telephone, as a consumer, you may withdraw from the contract without giving a reason within 14 days of its conclusion (§ 19(1) and § 20(1)(a) of Slovak Act No. 108/2024 Coll.). Simply notify us by email or post; you may also use the model form in Annex C. We will refund everything you paid within 14 days of receiving your notice (§ 22(1)). Once the voucher has been redeemed for specific dates, Article 5 applies.
14.3 [What happens to an unused voucher after expiry — TO BE COMPLETED BY THE OWNER; we recommend at least the option to extend it or receive a partial refund.]
15. Final provisions
15.1 Your booking is governed by the version of the terms you accepted when booking. Later changes do not apply unless you expressly agree to them.
15.2 The contract is governed by Slovak law. If you are a consumer habitually resident in another country, this choice of law does not deprive you of protection under that country’s mandatory provisions (Article 6(2) of Regulation (EC) No. 593/2008). Disputes are heard by Slovak courts; as a consumer domiciled in another EU country, you may also bring proceedings in the courts of your place of domicile (Regulation (EU) No. 1215/2012).
15.3 If any provision is invalid, the remaining provisions continue to apply.
15.4 Once approved, these terms will replace the General Terms and Conditions dated 1 June 2021 for bookings concluded from [EFFECTIVE DATE FOLLOWING APPROVAL].
